Opposition Procedure for Austrian Trademarks available

Please note that as per July 1, 2010 an opposition against Austrian trademarks will be possible.

The opposition procedure will be a fast and cost effective administrative procedure, similar to the OHIM procedure, for owners of an earlier trademark or trademark application with effect in Austria. There will be no oral proceedings and each party will have to bear their own costs.

 

The opposition must be filed within a term of 3 months after registration of the later trademark.

 

Please note that it is possible to establish a surveillance service for your clients’ trade names/trademarks in Austria in order to identify possibly conflicting trademarks or applications published in Austria and initiate opposition proceedings in time.
